Data security and data protection, email communication

Your personal data is protected by technical and organisational measures during collection, storage, and processing, ensuring it is inaccessible to third parties. In the case of unencrypted communication via email, we cannot guarantee complete data security during transmission to our IT systems. Therefore, for information requiring a high degree of confidentiality, we recommend encrypted communication or using postal mail.

Duration of data storage and rights of the data subject

Storage duration

We only store personal data to the extent and for as long as this is necessary for the fulfilment of the purposes for which the personal data were collected, we have a legitimate overriding interest in retention, or we are legally obliged to do so.

Right to information

You have the right to request confirmation as to whether we process personal data concerning you. If this is the case, you have the right to information about the details named in Sections 25 ff. of the DPA, insofar as the information cannot be refused, restricted or postponed by the data controller (cf. Articles 26 f. of the DPA). We will also gladly provide you with a copy of the data.

Correction claim

In accordance with Article 32(1) of the GDPR, you have the right to request that incorrectly stored personal data (such as address, name, etc.) be corrected, provided that no legal obligation prevents this claim. You can also request at any time that data stored by us be completed. An appropriate adjustment will be made immediately.

Right to erasure

You have the right to have the personal data we hold about you erased, if

• the data is no longer needed;
• due to the withdrawal of your consent, the legal basis for processing has ceased to apply without replacement;
• no legitimate grounds for processing exist any longer;
• Your data processed unlawfully;
• a legal obligation requires this.

The law does not exist when

• the processing is required for the exercise of the right to freedom of expression and information;
• Your data has been collected based on a legal obligation.;
• the processing is necessary in the public interest;
• data is necessary to establish, exercise or defend legal claims.

Right of withdrawal

If you have given us your express consent for the processing of your personal data (Art. 6 para. 6 of the Data Protection Act and Art. 31 para. 1 of the Data Protection Act), you can withdraw this consent at any time. Please note that the lawfulness of the processing carried out on the basis of your consent up to the point of withdrawal will not be affected by this. Data that we are legally obliged to retain will be deleted upon expiry of the retention period.

Right to data portability

We provide you with the following data upon request:

• Data collected on the basis of consent (Art. 31 para. 1 GDPR);
• Data that we have received from you within the scope of existing contracts (Art. 31(2)(a) Data Protection Act);
• Data that has been processed as part of an automated procedure.

We will transfer your personal data directly to a controller of your choice, insofar as this is technically feasible. Please note that we may not be able to transfer, or may only be able to transfer to a limited extent, data that interferes with the predominant interests of third parties pursuant to Art. 26(1)(b) GDPR.

Communications to the FDPIC and possibility of complaint

Affected persons may lodge a complaint with the supervisory authority pursuant to Art. 49 DPA if there are sufficient indications that data processing may violate data protection regulations. The supervisory authority for data protection in Switzerland is the Federal Data Protection and Information Commissioner (FDPIC).

If you suspect that your data is being unlawfully processed on our website, you can seek legal clarification of the issue in accordance with Art. 32 DPA. As a rule, a lawsuit in accordance with Art. 28 et seq. of the Swiss Civil Code should be pursued.
